Has the Tamil genocide been formally recognised?

As of the current era, several sub-national legislatures have adopted resolutions naming the events. The Government of Canada's Province of Ontario (Bill 104, 2021) and the Northern Provincial Council of Sri Lanka (2015) are among them. No United Nations organ has issued a formal genocide determination. The distinction between political recognition and judicial finding is preserved throughout this hub.

What do UN reports say?

The UN Secretary-General's Panel of Experts (2011) documented credible allegations of tens of thousands of civilian deaths and possible war crimes and crimes against humanity. The OHCHR OISL report (2015) reached similar conclusions. Neither report issues a Genocide Convention finding — a judicial threshold requiring specific intent (dolus specialis).

How does the Genocide Convention apply?

Article II of the 1948 Convention requires acts committed with intent to destroy, in whole or in part, a national, ethnical, racial, or religious group as such. The archive tracks the scholarly and legal debate on whether patterns in Sri Lanka's final phase, and in the wider historical record, meet that threshold — without pre-empting a judicial finding.
