The ICJ held that self-determination applies to non-self-governing peoples whose territorial and political identity pre-dates colonial arrangements, irrespective of legal ties to neighbouring states. The methodological holding — that the existence of a 'people' is determined by the historical and political record, not by the constitutional structure of the state currently exercising authority — is the part that travels beyond the colonial context.
