The ICJ found that Kosovo's 2008 unilateral declaration of independence did not violate general international law, customary international law, or UNSC Resolution 1244. The Opinion deliberately did not rule on whether Kosovo had a RIGHT to secede; it ruled only that international law contains no PROHIBITION on the declaration itself. /case/law cites Kosovo as the second leg of the remedial-self-determination reading, alongside Quebec — together they delineate the legal space in which the Tamil case sits, without claiming the Tamil case has been adjudicated.
